utilizados para descrever o objetivo do direito antitruste serem (i) o “bem-estar do consumidor”
(signicando, contudo, “excedente do consumidor”) e (ii) a “alocação eciente de recursos”, similar
à “eciência econômica” do direito americano, a Europa também arrola como alvos secundários do
seu direito antitruste (iii) a “concorrência no mercado” e (iv) a “integração do mercado” (JASPER,
2019, p. 177).
Analisando o ordenamento jurídico brasileiro como um todo, observa-se que o padrão da
multidimensionalidade do direito antitruste no ordem jurídico-econômica nacional não destoa
das jurisdições americana e europeia. Conforme apontam Castro (2018) e Souza (2006, p. 13), os
objetivos do direito antitruste vêm inscritos na ordem econômica nacional.
A defesa da concorrência brasileira é tutelada, no ordenamento jurídico, por mais de uma
norma, sendo a de mais relevância, por óbvio, a Constituição Federal. A CF/88 inaugurou uma nova
ordem econômica, orientada pelos princípios constitucionais de soberania nacional, propriedade
privada, função social da propriedade, livre concorrência, defesa do consumidor, defesa do meio
ambiente, redução das desigualdades regionais e sociais, busca do pleno emprego e tratamento
favorecido para as empresas de pequeno porte (art. 170, da CF/88). Igualmente, a Carta Magna
impôs o combate ao abuso do poder econômico pelo legislador infraconstitucional (art. 173, §4ª,
CF/88). O diploma infraconstitucional que mais extensivamente aborda a temática concorrencial é
a Lei de Defesa da Concorrência (LDF) – Lei Federal nº 12.529/2011 (versão atualizada da Lei Federal
nº 8.844/1994). Esta norma estrutura o Sistema Brasileiro de Defesa da Concorrência – SBDC e
dispõe sobre o escopo de atuação do Cade (BRASIL, 2011).
Na procura de algum norte sobre a(s) nalidade(s) do direito antitruste brasileiro na LDC,
depara-se, desde logo, com o art. 1 no capítulo denominado “Da Finalidade”, que arrola quatro
daqueles princípios constitucionais como orientadores do direito concorrencial brasileiro, (i) livre
iniciativa, (ii) livre concorrência, (iii) função social da propriedade e (iv) defesa dos consumidores,
bem como replica a determinação de (v) repressão ao abuso de poder econômico.

Ademais, analisando os §§5º e 6º do art. 88 do mesmo diploma, extrai-se como outros
objetivos da concorrência no Brasil (vi) o bem-estar do consumidor (entendido como excedente
do consumidor) e (vii) a eciência econômica.

Isso porque o Cade é autorizado a aprovar Atos
de Concentração (“AC”), que deveriam ser proibidos por violar a livre concorrência, se presentes
duas condições cumulativas: (1) alguma das eciências das alíneas ‘a’ a ‘c’ do inciso I do §6º e, (2)
necessariamente, excedente do consumidor.
É por isso que Jasper (2019, p. 181) conclui que a legislação parece indicar “objetivos
difusos” do antitruste nacional, i.e., liberdade de iniciativa, livre concorrência, função social da
propriedade, defesa dos consumidores/bem-estar do consumidor, repressão ao abuso do poder
econômico e eciência.
Interessante que, a partir de uma apuração dos precedentes do Cade, realizada em 2019,
o autor vai adiante e arma que a jurisprudência do Cade não foi capaz de articular, de forma

6 Art. 88, § 6º Os atos a que se refere o § 5º deste artigo poderão ser autorizados, desde que sejam observados os limites
