discussão sobre a possibilidade de acumulação entre as infrações previstas na alínea “d” do inciso
IV do artigo 5º da Lei Anticorrupção e a alínea “d” do inciso I do §3º do artigo 36 da Lei do Sistema
Brasileiro de Defesa da Concorrência, respectivamente, “fraudar licitação pública ou contrato
dela decorrente” (BRASIL, 2013) e “acordar, combinar, manipular ou ajustar com concorrente, sob
qualquer forma: [...] preços, condições, vantagens ou abstenção em licitação pública” (BRASIL, 2011).
Isso porque, embora esteja pacicada a existência de competências da CGU e do Cade para atuar
numa mesma situação concreta de fraude à licitação mediante atuação de cartel com base em tipos
infracionais autônomos, a acumulação de sanções poderia ser desproporcional ou desarrazoada.
Considerando os princípios da proporcionalidade e da razoabilidade, não pode haver dúvida
de que a prática das duas condutas ilícitas autônomas em discussão é uma ofensa ainda maior à
sociedade do que cada prática isoladamente de uma delas, causando danos mais profundos aos
valores sociais tutelados pelo Direito

. Ora, a formação prévia de um cartel confere muito mais
potencial lesivo à sociedade para fraudar licitações e, consequentemente, lesar o patrimônio público
do que uma fraude envolvendo uma única empresa em conluio com um único funcionário público;
além do que o cartel pode se manter para a prática de outras infrações, inclusive diversas da fraude
de licitações e contratos públicos.
No Direito Penal, a xação das penalidades quando há a prática de duas condutas ilícitas
diversas é solucionada pelos institutos do concurso de infrações, mais especicamente o concurso
material

. Nesse sentido, um exemplo do Direito Penal pode ser ilustrativo e contribuir, por analogia
de tratamento, para a solução do suposto conito entre as alíneas “d” do inciso IV do artigo 5º da Lei
n. 12.846/2013 (Lei Anticorrupção) e alínea “d” do inciso I artigo 36 Lei n. 12.529/2011 (Lei do Sistema
Brasileiro de Defesa da Concorrência). Suponha que 3 ou mais pessoas se associem para a prática de
crimes e, de fato, consumem a prática de roubo. A associação criminosa está prevista no artigo 288
do Código Penal, enquanto o roubo congura o delito autônomo do artigo 157 do mesmo diploma.
Não há dúvidas de que são praticados 2 crimes diferentes, em que um não é meio necessário para a
prática do segundo, havendo consequentemente concurso de crimes. Ora, o cartel é justamente uma
forma de associação ilícita, típica de empresas, e não é meio necessário para realizar fraudes, mas
necessariamente visa a prática de atos ilícitos. Então, em paralelo com a associação criminosa para
prática de outros delitos, caso o agente cometa as duas infrações administrativas, as penas devem
ser acumuladas:

12 A formação de cartel, por si só, causa efeitos gravíssimos à sociedade. Nesse sentido, cite-se Deschk (2016, p.
177, grifo nosso): “O cartel é considerado a mais grave lesão à concorrência, dentre as condutas anticompetitivas. Cartel é
um acordo entre concorrentes, cujo objetivo é eliminar a concorrência, podendo ser através de xação de preços, cotas de
produção, divisão de mercados, entre outros. O cartel traz enormes prejuízos para a sociedade, aumentando o preço dos
produtos e afetando sua disponibilidade no mercado, prejudicando os consumidores, o desenvolvimento da economia, e a
inovação tecnológica, afetando de maneira considerável o bem-estar social [...]”.
13 De acordo com o Código Penal (art. 69), haveria concurso material quando: “Quando o agente, mediante mais de uma
ação ou omissão, pratica dois ou mais crimes, idênticos ou não, aplicam-se cumulativamente as penas privativas de liberdade
em que haja incorrido” (BRASIL, 1940).
