Consiste a “multilateralidade” na presença, em uma mesma plataforma, de dois grupos de
“usuários”: de um lado, temos os usuários que se utilizam dos serviços ofertados pelas plataformas
de modo “gratuito”, isto é, sem que precisem dispor de qualquer quantia financeira para ter acesso
às redes sociais e aplicativos, mas fornecendo seus dados pessoais para que consigam aderir à
plataforma. Do outro lado, contudo, temos aqueles que financiam diretamente a plataforma ao pagar
certa quantia para, naquele espaço, anunciar seus próprios produtos e serviços, a partir dos perfis
de consumidores gerados pelos usuários que, gratuitamente, cederam seus dados à plataforma
(BUNDESKARTELLAMT; AUTORITÈ DE LA CONCURRENCE, 2016).
Cita-se como exemplo ilustrativo da multilateralidade a rede social Facebook, pertencente ao
grupo de mesmo nome, na qual usuários podem se cadastrar gratuitamente na plataforma, podendo
utilizar-se de seus serviços - jogos, eventos, chats de conversa - enquanto que anunciantes pagam
para exibir seus produtos no mesmo espaço.
Note-se, contudo, que o lado “gratuito” da plataforma é construído a partir de uma leitura
superficial daquilo que se considera “valor”. Conforme destacado pelo Fórum Econômico Mundial,
dados pessoais, na medida e velocidade com que podem ser coletados, armazenados, processados
e atualizados, representam hoje um importante ativo na economia mundial, permitindo a criação de
novas oportunidades de investimento para empresas e governos (WEF, 2011).
Por essa exata razão, pode-se afirmar que a aparente “gratuidade” de um dos lados das
plataformas digitais esconde a fundamental geração de valor a partir da variedade e quantidade de
dados fornecidos pelos usuários como condição para que a eles seja permitida a adesão aos serviços
e produtos oferecidos pelas plataformas.
A partir desse entendimento, pode-se compreender a segunda característica que se destaca
acerca das plataformas digitais: o amparo no uso de big data.
Consiste o termo “big data”, assim como os vários outros utilizados para se referir ao mercado
digital

, em objeto de difícil conceituação, dada sua abstratividade e impossível tangibilidade.
Entretanto, pode-se apontar uma definição que apresenta maior pacificação na literatura, a qual
compreende big data não apenas como um elevado volume de dados reunidos, mas como insumo
construído a partir da coleta, armazenamento, processamento e atualização de dados caracterizados
pela variabilidade, volume e velocidade e que, uma vez reunidos e detidos, permitem a tomada de
decisão informada (MONTEIRO, 2017).
Caracterizam-se, portanto, as big techs, por modelos de negócios pautados na construção
de perfis cada vez mais específicos de seus usuários a partir da utilização dos dados fornecidos e
adquiridos, de modo que possam oferecer ao lado que “paga” pelo uso de suas plataformas potenciais
alvos de publicidade, que tenderão a ser atraídos com mais certeza aos anunciantes (BAGNOLI, 2021).
O acesso, de tal modo, a elevada quantidade e variedade de dados pessoais fez surgir - ou
intensificar - preocupações sobre a legitimidade com que as plataformas digitais se utilizam de tais
insumos para conduzir seus negócios, implicando maior atenção voltada não apenas para potenciais
práticas anticoncorrenciais, mas ainda no que tange à liberdade do consumidor e à proteção da
