Antitrust policy in Brazil and the fight against cartels in light of the new CADE

Abstract

The Administrative Council for Economic Defense - CADE is a federal agency whose objective is the protection of free competition, one of the constitutional principles that guide the Brazilian economic order. Among the anti-competitive conducts, the cartel is the most serious injury to competition, as it seriously harms consumers by increasing prices and restricting supply, making goods and services more expensive or unavailable. The objective of this work is to analyze the consequences and procedures taken to identify and impose sanctions on cartel practices. It is a research based on a bibliographic survey complemented with field research at CADE itself. Therefore, by observing the aforementioned aspects, it is clear that in the practical field, Brazil considers the fight against cartels an absolute priority and in recognition of such an effort, the Brazilian System of Economic Defense-SBDC is considered, at the international level, as a organization that has stood out in recent years.
