The COVID-19 crisis and competition defense: challenges and perspectives in the light of OECD guidelines

Abstract

The crisis caused by the Coronavirus pandemic sparks a series of legal issues, which include labor relations, consumer protection, free competition, access to personal data for purposes of social monitoring, among others. This paper aims to shed light on the challenges and perspectives in the field of competition. First, it examines the competition issues including the practice of price gouging, the collaboration agreements between competitors, the acquisition of companies in financial difficulties, as well as the importance of competition in emergency public procurement proceedings. The, it continues with considerations on consumer protection and addresses the policy responses issued by the OECD on this matter. Finally, the paper concludes with an overview on future perspectives.
