Abstract

In the face of the COVID-19 pandemic, the Federal District Government issued the Decree No. 40.939/2020 with policies to prevent and contain the virus. This paper analyzes Article 11 of the aforementioned Decree, which states that it will be considered abuse of economic power to raise prices, without good cause, with the objective of increasing the prices of inputs and services related to the fight against COVID- 19 by arbitrary means. Thus, the objective of this research is to understand, under the lens of Competition Law, (i) the administrative power to decide on the existence of an ilegal practice against the economic order and (ii) to what extent exploitative pricing practices harm competition.
