Interoperabilidade por design ou por negação? A noção de interoperabilidade vertical no Digital Markets Act

Resumo

Objetivo: este artigo examina criticamente as constatações preliminares da Comissão Europeia sobre a implementação dos requisitos de interoperabilidade vertical pela Apple, com foco nos dois procedimentos de especificação instaurados pela Comissão (Processos DMA.100203 e DMA.100204).


Método: o texto baseia-se nos dois procedimentos de especificação instaurados pela Comissão Europeia contra a Apple, destacando a natureza multidimensional dos esforços da autoridade reguladora para garantir diferentes aspectos da interoperabilidade (técnicos, sintáticos, semânticos e organizacionais).


Conclusões: as conclusões da Comissão Europeia sobre as medidas de interoperabilidade vertical adotadas pela Apple evidenciam a busca por diferentes níveis de interoperabilidade. No caso dos dispositivos conectados, a eficácia é garantida pelos princípios de igualdade, equidade, não discriminação e razoabilidade, enquanto o processo baseado no sistema de solicitações da Apple propõe padrões mais amplos, mais próximos aos princípios de transparência e justificativa objetiva. A abordagem da Comissão Europeia para assegurar a interoperabilidade vertical nos termos do Digital Markets Act (DMA) representa uma mudança fundamental na regulação de ecossistemas digitais. Ao impor um regime de equivalência de entradas e refinar os contornos da interoperabilidade efetiva, a Comissão propõe um modelo regulatório proativo, voltado à abertura de ambientes digitais anteriormente fechados. O sucesso dessa experiência dependerá do grau em que a interoperabilidade por design possa ser aplicada de forma significativa, sem comprometer os incentivos legítimos à inovação.

Professora de Direito da Concorrência na Universidade Villanueva e Professora Visitante no Brussels Study Center. Atua como consultora de autoridades de concorrência em regulamentação digital, com foco em plataformas, gatekeepers e aplicação da lei europeia. É doutora em Direito da Concorrência pela Universidad Carlos III de Madrid. Especialista na área de antitruste, tanto pelo mestrado em Direito da Concorrência pela Universidad Carlos III de Madrid quanto pelo curso de curta duração em Direito Avançado da Concorrência da UE pela London School of Economics and Political Sciences.
