Abuse of a dominant position according to Cade's case law

Abstract

This study examined the jurisprudence of the Administrative Council for Economic Defense (Cade) regarding the abuse of dominant position. After a brief review of literature on the subject, a study on the precedents, in which there was a resolution of merit, between 2009 and 2019, involving unilateral conducts was conducted. About 20 precedents were reviewed, all with merit judgment. From this, it was possible to describe, in general, but without exhausting the subject, how Cade interprets art. 36 of Law No. 12.529/2011, as well as the use of core concepts such as market power and the rule of reason.
