Abstract

By the time discussions about third parties participation in administrative merger control are resumed, it is interesting to identify that this debate is reflected in judicial review proceedings. In this sense, this text aims to answer the following question: what is the role of third parties’ litigation in merger control in Brazil? Can foreign experience help? Based on the classification between internal and external third parties, it is intended to systematize and identify potential judicial remedies or those already sought by third parties in Brazil, using European experience, particularly the French one, as an illustrative framework.
