Novas tecnologias e concorrência: desigual é desleal? O caso Claro/Topsports/Fox

Abstract

 

the accelerated rhythm of technology innovation in different sectors of economy has prompted the debate about whether the obligations imposed by regulators to the traditional players of the market (the incumbents) should be equally enforced to entrants that use new technologies. Most frequently, the debate is oriented by two main arguments: that of the incumbents, which hold that a uniform treatment is necessary and inevitable; and that of the entrants, which try to demonstrate that their business model addresses old market failures and therefore the existing regulation is not fit for purpose. This article assesses these questions by a case study, the Claro/Fox/Topsports case (ruled by the National Telecommunications Agency, Anatel). The text analyses the interfaces between sectorial and competition regulations regarding the appliance of asymmetric regulation to good and services that are imperfect substitutes and, therefore, have overlapping zones of competition.
