Abstract

This article aims at analyzing the relevant changes implemented in Brazil regarding International Legal Cooperation between antitrust authorities. Recently enacted, the rules of the Decree No 7.738/12 and the Resolution Cade N o 1/12 represent an alignment of Cade with the recommendations of international fora on antitrust matters, as well as the most updated experiences on agency-to-agency cooperation by the other administrative agencies in Brazil. After examining general notions on International Legal Cooperation, the new Cade framework will be studied. As such, three topics will be focused: the Central Authority role on Mutual Legal Assistance in Antitrust Matters; the legal basis for the procedure and execution of the requests; and measures to be executed and the compliance with the lex diligentiae principle.
